Use of the Service: The Service is provided to users at Citizen Congress's discretion and may be altered, revoked, removed or cancelled at a point of Citizen Congress's choosing. Use of The Service should be conducted only through legal means and for legal purposes. Misconduct, misuse or any type of behavior that may compromise Citizen Congress or be viewed as a violation of acceptable behavior will result in Citizen Congress taking action against the user. These actions may include but are not limited to: blocking your access to the Service, removal or alteration of available Citizen Congress services and or legal action. All users engage in use of The Service, features and products of their own faculty and directive. How users choose to use information and resources found on Citizen Congress and what decisions or actions that may come of that use of information is solely at fault of the user. Citizen Congress is not responsible for events, consequences or actions that users encounter as a result of actions taken with influence of the Service, features or products.
You may only access or use the Service (including registering for the Service) if (1) you are 18 years of age or older, and (2) you have the power and authority to enter into these Terms of Use. If you are under the age of 18, you are not authorized to use the Service and must cease all use of the Service. The Service is for your personal, non-commercial use. You may not use the Service if we have terminated your account or banned you.

The Content provided by Citizen Congress, Third Party Licensors or Third Party Vendors contains trademarks, copyrights and other proprietary material, the ownership or licensed rights to which are held by such parties, as the case may be, and all such proprietary material is protected by law, including, without limitation, U.S. trademark and copyright laws and international treaty provisions.
The “look and feel” of the Service (including color combinations, text, images, the names and logos, button shapes, layout, design compilation and presentation of information and all other graphical elements, other than those owned or licensed by the Third Party Licensors or Third Party Vendors) are also Citizen Congress’s trademarks and/or copyrights, as the case may be.
You agree not to copy, reproduce, distribute, transmit, broadcast, display, sell, license or otherwise use or exploit any Content, except as expressly permitted under these Terms of Use, without the prior written consent of Citizen Congress or the legal owner of such Content.
Any unauthorized use of Content accessed through the Service may constitute trademark or copyright infringement, unfair competition, or other potential state or federal causes of action, as applicable, which could subject the user to substantial civil penalties, damages or other relief. The deletion or alteration of any copyright, trademark or other proprietary notices used or displayed through the Service is strictly forbidden. In cases where you feel like a copyright or other intellectual property right may have been infringed upon we ask that you contact us as instructed in this Service.
Except as otherwise permitted under these Terms of Use, Citizen Congress grants to you the limited, non-transferable right to view and use the Service, subject to these Terms of Use. All rights not expressly granted under these Terms of Use are reserved by Citizen Congress.
Accuracy of Content: Citizen Congress's Service is built on original Content derived from research conducted to the best of our ability with a keen focus on accuracy and integrity. The Content displayed, distributed or otherwise accessible through the Service may include information (which may include, without limitation, factual information, personal narratives, news information, advice, political or other opinions, prices offered for services, items for sale, item descriptions, and certain third-party terms of service) from various third-party sources, including Third Party Licensors, Third Party Vendors, and registered users of the Service. CITIZEN CONGRESS AND ITS AFFILIATES EXPRESSLY DISCLAIM ANY ENDORSEMENT, AFFILIATION OR SPONSORSHIP, OR OTHER ASSOCIATION BY OR WITH SUCH THIRD-PARTY BRAND OWNERS.
Usernames Passwords and registration information for the Service: You are obliged to maintain the confidentiality of any usernames or passwords that you may adopt and/or are provided by Citizen Congress in connection with your use of the Service. If you become aware of any unauthorized use of your username and password by any third party, you agree to notify Citizen Congress immediately at the Contact Information set forth in these Terms of Use. For your protection, if Citizen Congress believes that any unauthorized access may occur or has occurred, Citizen Congress may terminate access without prior notice to you. You also agree that Citizen Congress is permitted to act upon any instructions received using your username and password and to consider such instructions as authorized by you. Citizen Congress will not be responsible or liable for any loss or injury incurred by you for unauthorized use of your username and password, although you may be responsible or liable for any losses or injury caused by such unauthorized use.
When you register for the Service, you will be asked to provide accurate contact information and may also be asked to provide other information about yourself to help us better provide services to you or enhance your use and enjoyment of the Service. You warrant that all information provided at registration is accurate to the best of your knowledge. Citizen Congress does not endorse or accept any Communications as its own or representative of its views. By posting Communications through the Service, you grant Citizen Congress a perpetual, irrevocable worldwide, non-exclusive, royalty-free, sublicensable and transferable license to publish and display such Communications through the Service and to reproduce, distribute, transmit, use, archive, and prepare derivative works of such Communications in connection with the Service and Citizen Congress’s business, including, without limitation, to transmit and distribute such Communications to third-parties for their commercial uses, and to use such Communications for promotional and marketing purposes. • Do not misuse or abuse the voting systems or Content on Citizen Congress.
• Do not transmit ratings or reviews for any product or business in which you have a financial interest, or for any product or business of a competitor.
• Do not post Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, slanderous, libelous, vulgar, obscene, sexually explicit, pornographic, lewd, indecent, profane, racially, ethnically or otherwise objectionable, or that may invade another’s right of privacy or publicity or other personal rights.
• Do not post Content that infringes or otherwise violates any patent, trademark, trade secret, copyright or other intellectual property or proprietary rights of Citizen Congress or any third party.
Citizen Congress cannot review all Communications made on or through the Service and Citizen Congress is not responsible for screening or otherwise monitoring content submitted by Service users, whether in advance of, or after, posting. If a user notifies Citizen Congress that any Communications do not conform to these Terms of Use, Citizen Congress may, but is not obligated to, investigate the allegation and determine in its sole discretion whether to remove or request the removal of the Communications. Citizen Congress reserves the right, but has no obligation, liability or responsibility, to monitor the Service and edit, modify or delete any materials which Citizen Congress in its sole discretion determines to violate these Terms of Use or to be in any other way offensive, inappropriate or contrary to any Citizen Congress policy, applicable law or other regulation. You acknowledge that you have no expectation of privacy in any Communication, and no confidential, fiduciary, contractually implied or other relationship is created between you and Citizen Congress by reason of your posting a Communication to the Service.
Lawful Use: The Service may be used only for lawful purposes. • Collect or attempt to collect any information of other users of the Service, registered members or other members of the public without the subject’s consent, including without limitation usernames and passwords for the Service, Service account information, and personally identifiable information.
Violations of Service or network security may result in civil or criminal liability. Citizen Congress will investigate all occurrences which may involve such violations and may contact, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
Feedback Regarding the Service: You may provide suggestions, comments or other feedback on the operation of the Service, which may include, without limitation, ideas for new products, services, features, technologies, processes, materials, marketing plans or new product or service names (“Service Feedback”). Such Service Feedback is voluntary and Citizen Congress has the perpetual right to use any or all of such Service Feedback for any purpose without any obligation to you of any kind, although Citizen Congress will not publicly disclose the source of such feedback.
Disclaimer of Warranty: YOU AGREE THAT YOUR ACCESS TO AND USE OF THE APPLICATION ARE AT YOUR SOLE RISK.

These links and references are offered as a convenience and for informational purposes only, not as referrals or endorsements by Citizen Congress. YOU ARE ENTIRELY LIABLE FOR ACTIVITIES CONDUCTED BY YOU OR ANYONE ELSE IN CONNECTION WITH YOUR VISITING AND USE OF THIS SERVICE AND YOU ACKNOWLEDGE THAT CITIZEN CONGRESS SHALL NOT BE LIABLE FOR ANY CONTENT ACCESSED OR AVAILABLE THROUGH THE SERVICE, OR COMMUNICATIONS POSTED TO THE SERVICE, FOR ANY REASON WHATSOEVER.
IF YOU ARE DISSATISFIED WITH THE SERVICE AND/OR ANY CONTENT PROVIDED THROUGH THE SERVICE, OR WITH THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICE AND CONTENT.
The Service is controlled and offered from Citizen Congress’s facilities in the United States. Citizen Congress makes no representation that the Service is appropriate or available in other locations. Any access to the Service by you from jurisdictions other than the United States may be subject to compliance with local law, for which you are solely responsible.
Modifications and Changes of the Service: Citizen Congress reserves the right to modify, expand, remove, discontinue or change in any way the features, services, Content or other functionality of the Service in its sole discretion and without prior notice to you or other users. However, Citizen Congress may, in its sole discretion, notify you of such changes, although it is not required to do so. If any change is not acceptable to you, you must discontinue your use of the Service immediately. Indemnification: You agree to defend, indemnify and hold harmless Citizen Congress, its subsidiaries, affiliates, officers, directors, owners, employees, licensors, agents, co-branders and other partners from and against any and all liabilities, claims, demands, losses or expenses, including reasonable legal and accounting fees and costs, resulting or arising from: (a) your breach of these Terms of Use, including, without limitation, any representations or warranties made by you herein; (b) any action taken or permitted by you which disrupts, degrades or damages the Service, Content or related data thereon; (c) your infringement or other violation of any intellectual property right of Citizen Congress or any other person or entity; (d) any negligent, wrongful conduct, or intentional torts, by you; (e) any materials (including all Content and Communications) provided by you that is published on or through the Service or any third party web site pursuant to the rights granted to Citizen Congress hereunder; (f) your use of the Service; (g) your violation of the rights of any third party; or (h) your actual or alleged violation of any federal, state, local or foreign law, or regulations.
You agree that you will cooperate as fully and reasonably as required by Citizen Congress in the defense of any claim arising out of your use of the Service. Notwithstanding the foregoing, Citizen Congress reserves the exclusive right to settle, compromise and pay and all claims, demands, proceedings, suits, actions or causes of action, which are brought against Citizen Congress arising out of or related to your use of the Service, and in no event shall you settle any such claim without Citizen Congress’s prior written approval.
Termination: These Terms of Use are effective until terminated by Citizen Congress, which Citizen Congress may do at any time without notice for any reason. In the event of termination, you are no longer authorized to access the Service or use the Service. The applicable restrictions imposed on you with respect to material downloaded from the Service, indemnification obligations, and the disclaimers and limitations of liabilities set forth in these Terms of Use, shall survive such termination.
Governing Law and Venue: You agree and acknowledge that the Service shall be deemed a passive site that shall not give rise to personal jurisdiction over Citizen Congress in any jurisdiction other than the Commonwealth of Virginia, and that the Service shall be deemed solely located in the Commonwealth of Virginia.
These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without giving effect to any principles or conflicts of law. Any claim, cause of action or proceeding arising from these Terms of Use or the conduct of the parties hereunder shall be commenced and maintained solely in the courts of the city of Richmond in the Commonwealth of Virginia and of the United States District Court for the Eastern District of Virginia (Richmond Division), to the extent such court has subject matter jurisdiction, and you irrevocably consent to personal jurisdiction and venue in any such court.
Waiver of Jury Trial: You waive all rights to trial by jury in any action or proceeding instituted in connection with these Terms of Use, the Privacy Policy or the Service.

Any failure by Citizen Congress to exercise or enforce any legal right or remedy set forth in these Terms of Use, or otherwise under applicable law, shall not be deemed a waiver of Citizen Congress’ rights or remedies, which shall remain available to Citizen Congress.
The rights granted to you under these Terms of Use may not be assigned to any third-party without the prior written consent of Citizen Congress, in its sole discretion. These Terms of Use shall be binding upon you, your successors and approved assignees.
Your privacy is valued and respected by Citizen Congress, LLC (“we” or “our” or “us”). This Privacy Policy (“Privacy Policy”) provides important information on who we are, how and why we collect, store, use, and share your personal information. It also explains your rights in relation to your personal information and how to contact us in the event you have a complaint. This policy is intended to comply with privacy laws that may apply to you, including without limitation the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.
YOUR AGREEMENT TO THE PRIVACY POLICY
By accessing or using our CITIZEN CONGRESS mobile application (the “app”) or website located at www.citizencongress.app (the “Site” and together with the app, the “Services”), you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use our Services.
We reserve the right to update or modify this Privacy Policy from time to time. In all cases, your continued use of our Services constitutes consideration and your binding acceptance to any such changes. We encourage you to review this Privacy Policy regularly to ensure that you are familiar with our current practices.
The Services are available to, and intended for use solely by, residents at least 18 (eighteen) year of age who are located within the United States. We do not market or promote our Services to: residents located in any foreign country or any minors.

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).
Examples include: A name, signature, address, telephone number, education, employment, and employment history. Some personal information included in this category may overlap with other categories.
C. Commercial information.
Examples include: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
D. Internet or other similar network activity.
Examples include: Browsing history, search history, information on a consumer's interaction with a website, mobile application, or advertisement.
E. Geolocation data.
Examples include: Physical location or movements.
F. Professional or employment-related information.
Examples include: Current or past job history or performance evaluations.
G. Inferences drawn from other personal information.
xamples include: Profile reflecting a person's preferences, voting patterns, characteristics, psychological trends, predispositions, behavior, attitudes, and intelligence, abilities, and aptitudes.
This personal information is required to provide services to you. If you do not provide personal information we ask for, it may delay or prevent us from providing our services to you.
2. How Your Personal Information is Collected. We collect most of this personal information from the following categories of sources:
· Directly from you through our CITIZEN CONGRESS app, our Site, in person, by telephone, text or email.
· From publicly accessible sources (e.g., property records);
· Directly from a third party (e.g., credit reporting agencies, employee due diligence providers);
· From vendors and other third parties;
· From cookies on our Site; and
· Via our IT systems, including:
o Automated monitoring of our Site, the app, and other technical systems, such as our computer networks and connections, communications systems, email and instant messaging systems.
3. How We Use Your Personal Information. We may use personal information we collect about you on its own or combine it with other information we have about you to:
· Create user accounts and/or profiles through registration;
· Perform internal operations, such as tracking and improving the effectiveness of our website and marketing efforts;
· Provide Services and/or Site fulfillment, such as creating accounts;
· Personalize user experiences, such as remembering your settings and preferences for things like language, font size, etc.;
· Provide user support;
· Respond to requests from your regarding your personal information as required by applicable law.
· Advertise and market our products and services;
· Provide such information to elected officials, political campaigns and other businesses who purchase such information from us;
· Provide information to our representatives and/or advisors, such as our attorneys, accountants, and others to help us comply with legal, accounting, or security requirements;
· Protect the rights, safety, and information of Site users and third parties, as well as our own. This includes fraud prevention, business or product recalls, prosecuting and defending a court arbitration or similar proceeding, and more; and
· Comply with legal requirements, such as in response to a subpoena or similar investigative demand.
4. Who We Share Your Personal Information With. We routinely disclose or share personal information for our business purposes with:
· Third parties, including elected officials, political campaigns and other businesses who purchase such information from us;
· Our affiliates;
· Service providers we use to help deliver our Services to you, such as payment service providers, warehouses and delivery companies;
· Other third parties we use to help us run our business, such as marketing agencies or website hosts;
· Third parties approved by you, including social media sites you choose to link your account to or third-party payment providers;

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We may also share personal information with external auditors, e.g. in relation to ISO or investor accreditation and the audit of our accounts.
We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.
We may also need to share some personal information with other parties in connection with business acquisitions, such as potential buyers of some or all of our business or during a re-structuring.

6. Where Your Personal Information is Held. Information may be held at our offices and those of our third party agencies, service providers, representatives and agents as described above (see above: “Who We Share Your Personal Information with”).
7. How Long Your Personal Information Will Be Kept. We will keep your personal information while you have an account with us or while we are providing Services to you. Thereafter, we will keep your personal information for as long as is necessary:
· To respond to any questions, complaints or claims made by you or on your behalf;
· To show that we treated you fairly; or
· To keep records required by law.
We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information.

Right to Deletion
Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:
· Delete your personal information from our records; and
· Direct any service providers to delete your personal information from their records.
· Please note that we may not delete your personal information if it is necessary to:
· Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
· Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
· Debug to identify and repair errors that impair existing intended functionality;
· Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
· Comply with the California Electronic Communications Privacy Act;
· Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
· Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
· Comply with an existing legal obligation; or
· Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Protection Against Discrimination
You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:
· Deny goods or services to you;
· Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
· Provide a different level or quality of goods or services to you; or
· Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
Please note that we may charge a different price or rate or provide a different level or quality of services to you, if that difference is reasonably related to the value provided to our business by your personal information.
9. Keeping Your Personal Information Secure. We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

· Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill); and
· A description of what right you want to exercise and the information to which your request relates.
We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.
Any personal information we collect from you to verify your identity in connection with you request will be used solely for the purposes of verification.
11. Children and Privacy. As a requirement to use our Services, you acknowledge that you have the appropriate consent(s) from any individual (or the parent of any child under the age of 18) to share their personal information with us. We do not knowingly collect any personal information from children under the age of eighteen (18). We will delete any personal information collected that we later determine to be from an individual younger than the age of eighteen (18).
12. Third Party Sites and Services. Our Services may contain links to third party websites, applications and services not operated by us. These links are provided as a service and do not imply any endorsement by Citizen Congress of the activities or content of these sites, applications or services nor any association with their operators. Additionally, our Services may include social media features, such as the Facebook “Like” button, and widgets, such as the “Share This” button or interactive mini-programs that run on our Services. We are not responsible for the privacy policies or practices of any third party including websites or services directly linked to our Services. We encourage you to review the privacy policies of any third party site that you visit.
13. Security, Storage & Retention. The security of your personal information is important to us. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the internet, or method of electronic storage is one hundred percent secure and we cannot guarantee its absolute security. 14. Changes to This Privacy Notice. This privacy notice was published on March 30, 2020 and last updated on March 30, 2020. We may change this privacy notice from time to time and may inform you via our Site or the app or other means of contact such as email.
